Key Takeaways

  • THCA (tetrahydrocannabinolic acid) is a non-psychoactive precursor compound in cannabis from which THC forms.
  • Research shows THCA might have potential health benefits, including immune-modulating properties.
  • Per the 2018 federal Farm Bill, cannabis with less than 0.3% THC levels is legal.
  • THCA is legal in Wisconsin thanks to SB 119 and the 2018 Farm Bill.

What is THCA?

THCA stands for tetrahydrocannabinolic acid, one of two natural non-psychotropic precursors in cannabis, the other being CBDA. It is the compound from which delta 9 THC is formed.

In recent years, research has shown that this compound might have therapeutic value. However, unlike cannabinoids, it appears to exert its beneficial effects via other mechanisms and not through classical CB1/CB2 receptor binding.

It is thought to modulate the TRP channel receptors, especially the TRPA1 and TRPM8. It also displays the ability to inhibit cyclooxygenase enzymes COX1 and COX2. Experiments on rats suggest THCA might be a better anti-emetic agent than delta 9 THC.

THCA and Federal Law

The federal government’s position on THCA can be explained through the 2018 Farm Bill. This law legalized hemp, effectively making it an agricultural commodity. Since becoming legal, manufacturers have exploited hemp for its broad range of beneficial compounds.

In the all-important federal Farm Bill, hemp is distinguished from marijuana as:

The plant species Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.

The Hemp Act of 2018 had earlier proposed the removal of hemp from Schedule I controlled substances. This proposal was eventually incorporated into the Farm Bill.

The federal law does not explicitly refer to THCA. As a result, the legality of this cannabinoid is implicit. Overall, THCA is recognized as hemp if it is derived from cannabis with THC levels not exceeding 0.3%.

Wisconsin THCA Laws

Wisconsin’s THCA laws pretty much follow federal guidelines on cannabis laws. The provisions that legalize cannabidiol (CBD) more or less encapsulate THCA.

For instance, according to Wisconsin Statute §§ 94.67(15r) and 961.14(4)(t)1, the THC content of cannabis plants parts containing CBD be 0.3% or less to be lawful. This implicitly applies to THCA as well.

Wisconsin’s THCA laws are contained in SB 119, which spells out the guidelines for growing and processing industrial hemp.

Is THCA a Controlled Substance in Wisconsin ?

Since “industrial hemp” is no longer covered in the federal Controlled Substances Act, it is not a controlled substance under Wisconsin law. Accordingly, THCA derived from hemp is a non-contraband substance that people aged 21 and above can possess.

THCA Possession Limits in Wisconsin

Hemp-derived THCA is legal in Wisconsin, so it faces no restriction limits. Just as well because there are varieties of hemp products on the market worth trying out.

Is THCA Legal in Wisconsin?

THCA is likely legal in Wisconsin thanks to the 2018 Farm Bill and Wisconsin’s Senate Bill 119. However, always check out the legality of hemp in states you intend to visit. The rules governing hemp production and processing are in a constant state of flux.

So, while THCA may be legal in Wisconsin, it may not be in other states.

Is THCA Safe?

Generally, THCA is well-tolerated and safe in its raw form. It is non-psychoactive and non-addictive. It can be blended into juices or smoothies. THCA flower can also be smoked. However, when heated, THCA converts into THC, meaning smoking THCA flower can be intoxicating.

Still, most people tolerate the ‘high’ quite well and even find it therapeutic. However, since THCA easily converts into THC when heated, it could lead to positive drug tests. This can be an issue for people whose professions require frequent testing.
