HHC stands for hexahydrocannabinol, which is a cannabinoid, and, technically speaking, an isomer of THC. HHC, although usually not in high quantities, can be found in quite a few strains of weed, and yes, just like THC, it is psychoactive, although not quite as strong as delta 9 THC but stronger or about equal to delta 8 THC.

Now, things get a bit confusing in the USA as far as cannabis and HHC are concerned, mainly because federal and state level authorities don’t always share the same opinions. In terms of federal law, HHC should be legal, which should also be the case for the state of Texas, according to recent laws.

HHC and Federal Law

As far as federal law in the USA is concerned, according to the wording, it should be legal. It all comes down to the 2018 Farm Bill. The bill says that any derivatives of hemp or the hemp plant that contain 0.3% THC or less are legal.

However, although this Farm Bill seems to be referring to CBD products, it does not mention HHC or any of the other cannabinoids for that matter. Realistically, according to federal law, HHC is legal so long as it has less than 0.3% THC and so long as it is derived from the hemp plant.

 

Texas HHC Laws

As far as Texas is concerned, HHC should also be legal, at least for the time being. In 2019, Governor Greg Abbot signed Texas House Bill 1325, which made hemp-derived CBD products legal to buy, possess, and sell. The rules here are generally the same as with the federal Farm Bill, meaning that the CBD products must come from a hemp plant that contains less than 0.3% THC.

On a side note, the ban on processing and manufacturing smokable hemp products, such as smokable THC, was upheld in June of 2022. So, while you can possess hemp-derived CBD in Texas, as well as buy and sell it, you can’t grow (hemp plants) or process it within the state.  

As is the case with the federal Farm Bill, HHC is never mentioned. However, it is safe to assume that if the HHC is derived from a hemp plant with under 0.3% THC, it should be totally fine.

Things do get even more complicated because, in 2020, the DEA stated that delta 8 THC is illegal in Texas because it is synthetically derived from CBD. Well, HHC is also synthetically derived from CBD, which according to the DEA, does make it illegal. 

 

Is HHC a Controlled Substance in Texas?

As long as it contains less than 0.3% THC, and comes from a hemp plant with equally little THC, then now, it is not a controlled substance. 

However, marijuana and any other hemp product with over 0.3% is considered a controlled substance, and as Texas is known for, the penalties for possessing these substances can be quite severe.

 

HHC Possession Limits in Texas

At this time, any hemp-derived CBD products can be possessed in unlimited quantities. As mentioned earlier, both federal and state laws never mention HHC specifically, but they do say that as long as the hemp product comes from a hemp plant with less than 0.3% THC, it is legal. There are no possession limits on HHC in Texas at this time.

The answer here is that in all reality, as long as the HHC comes from a hemp plant with less than 0.3% THC, it should be legal. However, this is only for the time being because, as mentioned above, according to the DEA, HHC that is synthetically derived from CBD is not legal.
