A new and popular cannabinoid, HHC (or hexahydrocannabinol) has been grabbing significant attention in the cannabis world. HHC is a mildly psychoactive cannabinoid found in hemp that can be harvested and cultivated into HHC products that cannabis users can enjoy.

HHC closely resembles other cannabinoids such as delta 8 THC, with its uniqueness lying in the energetic and uplifting feelings users have reported. This has made HHC become extremely popular in the cannabis world.

Because HHC is so new and because the legality surrounding cannabis and its cannabinoids is constantly changing, it can be difficult to pinpoint in which states cannabinoids like HHC may be legal. In this article, we’re going to take a look at whether or not HHC is legal in Kentucky.

Key Takeaways

  • As long as it’s hemp-derived and has less than 0.3% THC, HHC is federally legal, according to the 2018 Farm Bill.
  • In Kentucky, HHC is legal as long as it complies with the Farm Bill.
  • Delta Munchies is your best provider of legal HHC products in Kentucky.

HHC and Federal Law

HHC is federally legal in the United States. However, HHC is not legal in all 50 states as each state has its own individual laws pertaining to cannabis and different cannabinoids. A bill called the Farm Bill was passed in 2018 that legalized certain cannabinoids if they were found in hemp and contained 0.3% THC content. HHC fell under this “cannabinoid loophole” meaning that it became federally legal to buy and own in the United States.

Kentucky HHC Laws

Kentucky state law mirrors United States federal law which states that HHC is legal as long as it is hemp-derived and contains 0.3% THC content or less.

Is HHC a Controlled Substance in Kentucky?

According to the National Cancer Institute, a controlled substance is: “A drug or other substance that is tightly controlled by the government because it may be abused or cause addiction. The control applies to the way the substance is made, used, handled, stored, and distributed. Controlled substances include opioids, stimulants, depressants, hallucinogens, and anabolic steroids. Controlled substances with known medical use, such as morphine, Valium, and Ritalin, are available only by prescription from a licensed medical professional. Other controlled substances, such as heroin and LSD, have no known medical use and are illegal in the United States.”

Marijuana (nor HHC) is mentioned in this definition of a controlled substance, however, there are other entities that describe them differently.

The Drug Enforcement Agency deems marijuana to be a controlled substance, declaring: “Marijuana is a Schedule I substance under the Controlled Substances Act, meaning that it has a high potential for abuse, no currently accepted medical use in treatment in the United States and a lack of accepted safety for use under medical supervision. Although some states within the United States have allowed the use of marijuana for medicinal purposes, it is the U.S. Food and Drug Administration that has the federal authority to approve drugs for medicinal use in the U.S. To date, the FDA has not approved a marketing application for any marijuana product for any clinical indication. Consistent therewith, the FDA and DEA have concluded that marijuana has no federally approved medical use for treatment in the U.S. and thus it remains as a Schedule I controlled substance under federal law.”

So, is HHC a controlled substance in Kentucky? No, HHC is not considered a controlled substance in Kentucky. Because HHC is such a new cannabinoid, there are not many legal documents and statements that specifically mention HHC. This means that most state laws regarding HHC reflect federal law, which means that as long as the HHC is hemp-derived and has 0.3% THC content or lower, it is completely legal.

HHC Possession Limits in Kentucky

At this time, there are no specific possession limits regarding HHC in Kentucky. Again, because HHC is such a new cannabinoid, legal documents, statements, and state laws haven’t included it in their verbiage. So, as long as the HHC is legally obtained and remains under the 0.3% THC content enforced by federal law, HHC is completely legal to buy and own in Kentucky.

Is HHC Legal in Kentucky?

Under the 2018 Farm Bill, hemp-derived THC was federally legalized in the United States as long as the THC content was 0.3% and under. This opened the door (or have many people have dubbed it, the “cannabinoid loophole”) for cannabinoids like hemp-derived HHC, delta 8 THC, and delta 9 THC to be harvested and cultivated into cannabinoid products.

Many states have mirrored this legality and allow hemp-derived HHC to be legally sold there as long as it adheres to the federal guidelines of 0.3% or less. So, is Kentucky one of those states? Yes, as long as the HHC is hemp-derived and contains 0.3% THC or less, HHC is legal in Kentucky.
