Sure, you might be familiar with THC and CBD, the two most common cannabinoids found in marijuana. But have you heard of the HHC? A less well-known cousin of THC and CBD that is no less important. Let’s learn a little about hexahydrocannabinol and its legal status.

HHC can be found in many weed strains, although it can be hard to come across, which is why it is often synthetically produced in labs using so-called hydrogenation processes, which is when hydrogen atoms are added to the THC molecules.

In terms of the effects of HHC, yes, it is psychoactive, and the effects of it are very similar to THC. Although, HHC is not quite as strong as delta 9 THC, and produces a tamer and less intense high, kind of like THC for beginners. Most people would say that an HHC is very relaxing. 

With all of that being said, whether or not HHC is legal is questionable, although technically, at this time, it can be argued that it is. If we are talking about the USA, there is the 2018 Farm Bill, which according to its wording, does imply that there are no restrictions against HHC federally.

As far as California is concerned, there also doesn’t appear to be any restrictions against HHC in this state. But its legal status is a bit complicated, so let’s take a closer look. Is HHC legal in California?

HHC and Federal Law

The issue with HHC in the USA, as far as the federal government is concerned, is that the wording on its legality is very unclear. Technically, HHC is legal on a federal level. This is thanks to the 2018 Farm Bill. The 2018 Farm Bill states that CBD and other derivatives of hemp, including HHC, are legal. But in order for HHC, CBD, and these other cannabinoids to be considered legal, the products containing these compounds must be derived from the hemp plant, not the marijuana plant. In the regulations set out by the 2018 Farm Bill, products made from the hemp plant must not contain more than 0.3% THC.

However, things do get a little confusing, because HHC is very closely related to THC. HHC is a so-called isomer of THC, which means that it has the same formula as THC, but the atoms in the molecules are arranged in a different manner.

Technically speaking, this would make HHC illegal federally. 

 

California HHC Laws

As far as marijuana products of all sorts are concerned, California is one of the most relaxed states in the USA. After all, California was the first US state to legalize medical cannabis, well over 20 years ago.

Of course, there are still some restrictions in place, particularly in terms of THC and possession limits related to it.

However, as far as HHC is concerned, this is a different story. According to California state law, extracts that are derived from hemp, not from the marijuana plant, are totally exempt from restrictions that relate to cannabis. So, yes, HHC is legal in California on a state level as long as it is derived from hemp.

 

Is HHC a Controlled Substance in California?

Keeping in mind that the discrepancies between US federal law and California state law make things a bit confusing, as long as HHC is derived from a hemp plant it is not a controlled substance.

That said, it is kind of up in the air at this point, because as far as THC is concerned, it is not a controlled substance on a state level, but it is still listed as a controlled substance according to federal laws.

However, going back to the 2018 Farm Bill, any product derived from hemp plants with less than 0.3% THC is not controlled. The issue is of course that HHC is an isomer of THC, which can make things a bit complicated.

 

HHC Possession Limits in California

Although HHC is legal in California, there do still seem to be some possession limits. Now, generally speaking, these really only applied to THC and CBD. The issue here is that HHC is so new, that the current laws don’t really address it at all.

That said, according to California state law, people over the age of 21 may possess up to one ounce of cannabis plant material (the buds or flowers) and up to 8 grams of cannabis concentrates. Seeing as HHC oils and vapes are technically cannabis concentrate, it is safe to assume that the 8 gram limit does apply to HHC.

Yes, HHC is legal in California. As long as it comes from a hemp plant with less than 0.3% THC, it should be totally fine.
