Key Takeaways

  • HHC laws in Arizona are still a bit unclear.
  • However, it is safe to assume that HHC is illegal in Arizona since the law only explicitly allows delta 9 THC.
  • Arizona prohibits the recreational consumption of all isomers of THC, which may include HHC.

HHC and Federal Law

It doesn’t matter if you reside in Arizona and you’re taking a trip there. If you’re considering trying HHC, you’d want to know if it’s legal in The Grand Canyon State.

But first, let’s explore what the federal government says about HHC.

According to the 2018 Farm Bill, all cannabinoids and cannabis derivatives derived from a hemp plant that contains 0.3% THC, or less, on a dry weight basis are legal. In other words, as long as the hemp plant derivative contains no more than 0.3% THC, it is on the right side of the law.

In light of this, HHC is technically legal under federal law.

While most manufacturers won’t directly extract HHC from the hemp plant since it is not a very abundant cannabinoid, they can derive it from delta 9 THC, which is a more abundant cannabinoid that occurs naturally in hemp and cannabis plants.

However, you should note that federal laws do not explicitly address the legality of HHC (or hexahydrocannabinol). But the good part is the legislature does say it is illegal either.

Arizona HHC Laws

Due to the recency of HHC on the cannabis market, many laws are still playing catch-up, and Arizona state laws are no different. As a result, there are still no specific regulations regarding HHC in Arizona.

But here’s what we do know.

Arizona prohibits the manufacture, sale, or consumption of psychoactive cannabinoids derived  from the entire cannabis genus — either hemp plant or cannabis, with the exception of delta 9 THC. This means that products containing isomers THC (like delta 8 and delta 10) are classified as a controlled substance under Arizona law, regardless of their percentage of THC.

Since HHC doesn’t exist naturally, is generally derived from THC, and is also a psychoactive substance that will show up in a drug test, it follows that this product may also be illegal in Arizona.

Therefore, while Arizona may not have any clearly defined HHC laws right now, HHC is likely closer to the wrong side of the law than any legal gray area.

Is HHC a Controlled Substance in Arizona?

Admittedly, HHC laws are lacking. But, even worse, existing cannabinoid laws can also be quite confusing.

So, is HHC legal?

In Arizona, recreational cannabis has been legal since 2020. But it is also still considered a controlled substance. As a result, the only THC that you can purchase and consume for recreational purposes is delta 9 THC.

In other words, the law prohibits other forms of THC, like delta 8, and other derivatives for that matter.

Since HHC is not delta 9 THC itself and is only a by-product, it may be safe to say that HHC falls under the class of controlled substances in Arizona.

HHC Possession Limits in Arizona

Since the law is a bit unclear about whether you can buy and consume HHC freely in Arizona, we would recommend keeping possession as close to zero as possible. This way, you reduce the chances of a potential clash with the law.

Is HHC Legal in Arizona?

HHC is in the legal gray area when it comes to the legislature in Arizona. This is because the law only permits the recreational sale, purchase, and use of delta 9 THC, and not its isomers or derivatives.

In other words, delta 9 THC is legal. But, delta 8 and delta 10 THC are prohibited substances.

Therefore, since HHC is a product of the hydrogenation of delta 9 THC, making it an isomer, it is not a far leap to conclude that HHC may be illegal in Arizona.

Where to Buy HHC in Arizona

There are several theories on why HHC laws are lacking in many states. Some say it is because HHC has not been around for long enough while others believe it is because HHC is not a stand-alone cannabinoid. That is, it is hemp-derived.

Either way, it is important to be careful and research your region’s laws extensively before trying to buy or consume HHC and other related substances.
