While the United States has protected products containing less than 0.3% delta 9 THC in most states through the 2018 Farm Bill, the rest of the world is still catching up.

Not to worry, though: most experts agree that delta 8 THC can be legal in some countries in Latin America, including Colombia.

However, just like in the U.S., the laws surrounding minor cannabinoids are vague and leave a lot of room for interpretation.

What is Delta 8 THC?

Delta 8 THC is not regular marijuana, it isn’t typical weed, and it isn’t familiar dope. Yes, both delta 9 and delta 8 are forms of THC, but their small molecular distinctions make a big difference. 

Although it can have psychoactive properties, delta 8 is usually extracted from hemp, which contains less than 0.3% tetrahydrocannabinol, the main psychoactive component usually found in the weed we all know and love.

However, delta 8 is quite similar to delta 9. So similar, in fact, they’re chemical cousins. Cannabis and hemp both have atom carbon chains. While delta 9 THC holds its double bond on the ninth carbon, delta 8’s double bond sits on the eighth carbon. 

Because of this, it interacts differently with your endocannabinoid system, producing similar effects to regular THC but much milder.

What Is The Difference Between Delta 8 and CBD?

CBD and delta 8 THC are also often confused as being the same, but they are far from it.

  • Bolivia: completely banned
  • Colombia: legal for medicinal and scientific use
  • Chile: legal for medicinal use
  • Ecuador: completely banned
  • Guyana: completely banned
  • Paraguay: legal for medicinal use
  • Peru: legal for medicinal use
  • Suriname: completely banned
  • Uruguay: entirely legal, can be sold over the counter
  • Venezuela: completely banned

 

Is Delta 8 Legal in Colombia?

It can be argued that hemp-derived delta 8 THC is legal in Colombia.

As we mentioned earlier on, the laws surrounding hemp-derived products are up for interpretation. Still, let’s look at the specific legality of cannabis in Colombia to learn more.

When it comes to weed in general, a law was passed in 2016 allowing for its medicinal and scientific use. Said law also excluded hemp as a psychoactive and sees it for what it really is: an agricultural product that opens a lot of doors in many industries, not just in the creation of recreational or medicinal hemp-derived products.

Just like in the U.S., it highlights that licenses can be given out to extract cannabinoids that contain less than 0.3% of delta 9 THC.

Since then, more laws have been put in place. Earlier this year, the country’s Congress established a legal framework concerning the industrial and scientific use of hemp in Colombia.

This law opens up so many opportunities for the country, both internationally and for Colombian citizens, due to the generation of employment, industry growth, and redirection of illicit growth and activities. 

However, the laws are still fuzzy around the recreational use of hemp-derived products that contain less than 0.3% of delta 9 THC, including delta 8 THC.
